ClickTalent ("ClickTalent," "we," "us," or "our") provides a marketplace platform based in San Francisco, California that connects employers and companies with marketing professionals. Our services include account creation, employer workspaces, talent profiles, job posts, AI-assisted job creation and editing, talent matching, applications, shortlisting, messaging, agreements, invoices, payment workflows, and related platform tools.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit our website, create an account, use our platform, communicate with us, make or receive payments through the platform, or otherwise interact with ClickTalent.

This Privacy Policy is intended to describe our privacy practices. It does not create contractual rights beyond those required by applicable law.

1. Information We Collect

We collect information you provide directly, information generated through your use of the Services, and information from third-party services you choose to use with ClickTalent. The exact information we collect depends on how you use the platform, your role, your settings, and your interactions with other users.

We may collect account information such as name, email address, password or authentication credentials, account role, profile photo, login method, account settings, preferences, and account status. Login methods may include email/password, Google OAuth, and magic link authentication.

1.2 Employer and Company Information

If you use ClickTalent as an employer or company representative, we may collect company or organization name, company website, industry, company size, location, company description, hiring focus, employer workspace information, job posts, draft jobs, hiring briefs, shortlists, application reviews, application status updates, agreements, invoices, and related hiring workflow activity.

1.3 Talent Profile Information

If you use ClickTalent as a talent or marketer user, we may collect headline, bio, location, skills, specialties, tools, certifications, industries, titles, experience, years of experience, seniority, availability, rates, portfolio links, resumes, case studies, uploaded documents, applications, cover notes, proposed rates, application statuses, and related engagement records.

1.4 Profile Visibility Information

Talent users may control whether their ClickTalent profile visibility is turned on or off. When profile visibility is turned on, profile information may be discoverable by employers or other authorized platform users through search, discovery, AI matching, recommendations, shortlists, or related marketplace features.

When profile visibility is turned off, ClickTalent will not intentionally display the talent profile in employer-facing discovery or matching results. However, information may still be processed or retained as needed to operate the account, maintain platform security, comply with legal obligations, resolve disputes, preserve records, or support prior interactions such as applications, messages, agreements, invoices, payments, or engagements.

1.5 Job, Matching, and Marketplace Information

We may collect job titles, descriptions, skills, tools, industries, responsibilities, budget, seniority, location, job status, talent matches, job matches, match scores, shortlists, applications, agreements, invoices, payment status, marketplace engagement, platform activity, and related workflow records.

1.6 Communications

We may collect communications sent or received through ClickTalent, including chat threads, messages between employers and talent, support messages, emails, notifications, feedback, questions, and related metadata.

1.7 AI Feature Inputs and Outputs

ClickTalent may use AI-powered features to help create or edit job posts, extract job fields, ask clarifying questions, suggest role details, generate draft descriptions, support talent or job matching, and improve platform workflows.

When you use these features, we may process text you enter, pasted briefs, existing job drafts or job posts, extracted job fields, AI-generated suggestions, AI-generated summaries, patch instructions, structured draft information, profile data, job data, and related matching data.

You should not submit sensitive personal information, confidential business secrets, or information you are not authorized to share through AI features.

1.8 Payment and Transaction Information

Payments related to contracts facilitated by ClickTalent are processed through the ClickTalent platform using Stripe. When payments are made or received through ClickTalent, we and Stripe may collect and process payment-related information, including billing details, payout details, transaction history, invoice records, tax-related information, identity verification information, fraud prevention data, chargeback or dispute information, and related payment records.

Stripe may process payment information under its own legal terms and privacy practices. Users may be required to agree to Stripe's applicable terms before receiving payouts or processing payments through ClickTalent.

1.9 Authentication, Device, and Usage Information

We may automatically collect IP address, device type, browser type, operating system, referring pages, pages viewed, clicks, account activity, login activity, session activity, token activity, error logs, diagnostic data, and other information about how you use the Services.

1.10 Cookies and Similar Technologies

We may use cookies, local storage, pixels, SDKs, and similar technologies to keep you signed in, remember preferences, secure accounts, analyze performance, improve user experience, measure product usage, and support marketing or analytics where permitted by law.

You can adjust browser settings to refuse or delete cookies. Some platform features may not function correctly without cookies or local storage.

2. How We Use Information

We use personal information to provide, operate, secure, maintain, and improve ClickTalent and to support the marketplace relationship between employers and talent.

2.1 Platform Operations

We use information to create and manage accounts, authenticate users, support role-based access, operate employer workspaces, build and manage talent profiles, create and manage job posts, enable applications, shortlists, chat, agreements, invoices, payments, and related workflows.

2.2 Matching and Marketplace Functionality

We use information to match employers with talent and talent with jobs, calculate relevance signals, rank or recommend jobs or profiles, show strengths and gaps, support shortlists, and help users evaluate potential engagements.

2.3 AI-Assisted Features

We use information to provide AI-assisted job creation, editing, field extraction, clarifying questions, draft generation, matching, recommendations, and related product improvements. AI outputs should be reviewed by users before publication, hiring decisions, payment decisions, or other reliance.

2.4 Payments and Compliance

We use information to facilitate payments through Stripe, route payouts, process invoices, support refunds or chargebacks, detect fraud, comply with tax and accounting obligations, maintain transaction records, and enforce payment-related platform rules.

2.5 Communications and Support

We use information to send transactional emails, magic links, security notices, platform notifications, support responses, service updates, and other communications related to your account or use of the Services.

2.6 Security, Safety, and Legal Compliance

AI-generated suggestions may be incomplete, inaccurate, biased, outdated, or unsuitable for a particular purpose. Employers and talent are responsible for reviewing AI-assisted content before relying on it, publishing it, sending it, or using it in a hiring or engagement decision.

ClickTalent does not guarantee that AI-generated matches, recommendations, summaries, job drafts, profile insights, or scores are accurate, complete, unbiased, or suitable for any particular purpose.

4. How We Share Information

We may share information as described in this Privacy Policy, as directed by you, or as otherwise permitted or required by law.

4.1 With Other Users

Depending on your role, visibility settings, and platform activity, employers may see talent profile information, applications, proposed rates, portfolio links, messages, agreement information, and related application or engagement details. Talent users may see active job posts, company information, messages, payment or engagement status, and application-related updates. Users in a chat thread may see messages and related conversation context. Employers may see shortlists, application statuses, agreements, invoices, and payment-related status for their jobs.

4.2 With Service Providers

We may share information with vendors and service providers that help us operate ClickTalent, including cloud hosting providers, database providers, infrastructure providers, email providers, authentication providers, analytics providers, AI model providers, error monitoring providers, logging providers, customer support tools, payment processors, fraud prevention providers, and other operational vendors.

4.3 With Stripe and Payment Partners

We share payment and transaction information with Stripe and related payment, payout, fraud prevention, dispute, tax, and compliance service providers as needed to process payments, route payouts, verify identity, manage chargebacks or disputes, prevent fraud, and comply with legal obligations.

4.4 With AI Providers

If AI features are enabled, content you submit and relevant platform context may be sent to third-party AI providers to generate responses, extract job data, edit drafts, provide recommendations, or support matching functionality.

4.5 Business Transfers

We may disclose information in connection with a merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar transaction involving all or part of our business.

4.6 Legal and Safety Reasons

5. Public and Shared Content

Some content you provide may be visible to other users depending on your role, account settings, profile visibility, and platform activity. Talent profile information may be visible to employers when visibility is turned on. Active job posts and company information may be visible to talent. Chat messages are visible to participants in the conversation. Agreements, invoices, and payment status may be visible to relevant parties to an engagement.

Do not post or submit information you do not want shared with relevant platform users or service providers.

6. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, maintain security, prevent fraud, support tax and accounting records, and pursue legitimate business purposes.

Retention periods may vary based on the type of information, your account status, legal requirements, operational needs, and whether the information relates to payment records, contracts, invoices, applications, communications, security logs, or prior engagements.

7. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These may include access controls, authentication, token-based sessions, encryption in transit, logging, monitoring, and security reviews.

We collect and use personal information to provide, operate, and secure ClickTalent; create and manage accounts; authenticate users; build and manage employer workspaces and talent profiles; enable job posts, applications, shortlists, chat, agreements, invoices, and payments; process payments through Stripe; provide AI-assisted job creation, editing, matching, and recommendations; improve platform quality, safety, and reliability; prevent fraud, abuse, security incidents, and unauthorized access; provide support; comply with legal, tax, accounting, and regulatory obligations; and enforce our Terms of Service.

9.3 Sale or Sharing

ClickTalent does not sell personal information for money. If we engage in activities that are considered a "sale" or "sharing" of personal information under California law, we will provide required notices and opt-out rights.
